The Community Financial Services Association argues that at 36 percent rate cap, the one in place for members of the military, is a death knell because payday lenders can not make money at that rate, and this seems to be correct. In states that their rates are at 36% per year or lower, the payday lenders vanish. In New York, which caps payday loans at 25 percent a year, there are no stores at all.

As Clarence Hodson, who published a book in 1919 about the business of small loans, put it, “It is not possible for bargain to benefit with cupidity.” In its last financial year, Advance America, one of the country’s largest payday lenders, wrote, “We believe that the main competitive factor is customer service, rental, convenience, speed, and confidentiality.” You will notice it did not mention the price.
